Statement on Charitable Gaming Issues

To our wonderful poker community,


The judgment for an injunction was denied.  Essentially, we will need to wait until we are issued our license from VDACS so that we can play the game we love.


We are still in the early stages in terms of charitable poker in the State of Virginia and the path to poker is difficult.  Although charitable poker was handed a temporary loss, we feel confident that our continued efforts will prevail sooner rather than later.


It’s a great journey and we are enjoying the ride, because in the end, we’ll all be playing poker and helping charities.


We are currently working on our plans moving forward.  There may be a few changes coming, but we intend to offer the same great experience that you have come to love at Pops.


Our mission statement remains fourfold:

To preserve the integrity of the game

To provide excellent customer service

To ensure a safe and secure place for people to enjoy poker

To promote the fun and well being of the game to our patrons


We have loved, and will continue to love, the community that you helped us to build.

The Pop's Poker Freerolls have been off the charts!  


We have consistently packed the house and folks are having a great time!  Come join the fun!


The freeroll has NO BUYIN, just play poker, have fun and win money.  While you are here, check out Pop's, eat some great food, and let's keep our poker community in touch and playing while we wait for the law to settle down.


If you have a player's card, please bring that with you.  If you do not already have a Pop's Poker player's card, please bring your ID in order to register, and anticipate a delay in registration, so please show up EARLY to register. Registration will begin at 5:30pm.


The payouts are as follows:

  • 1st place - $300
  • 2nd place - $200
  • 3rd place - $100
  • 4th place - $50
  • + $100 high hand (HH)!


Registration will open at 5:30pm, cards in the air at 6pm.


The $100 high hand requires that the hand is at least the rank of a full house and you must use both of your hole cards to make your hand.  The high hand is ONLY through the first 10 levels of play.


Seats are now assigned on a first come, first served basis.  We are NOT using EventBright to sign up anymore.  After all seats are filled, we will keep a running "waiting list" of the next players to be called in order of their arrival and check-in at the cage.  Players on the waiting lis will be called in order (as other players bust out of the tournament) in the order that they arrived and got their name put on the waiting list at the cage.  


Please get there on time to insue a sea at the freeroll.


Due to security and staffing, the game  must end at midnight.  This can be accomplished by chopping using either ICM or even chop.  If the remaining group cannot decide how to chop the tournament, it will be based on an ICM Chop  Calculator.


  • Re-entries are not allowed.
  • Food and beverages will be available for purchase from Pop's Bar and Grill.
  • All televised sporting events will be available on our 60+ TVs!
  • Live dealers will be dealing and handling all of the action!
  • Tournament Directors Association (TDA) rules apply to all tournaments.

Statement on Charitable Gaming Issues

The fight continues to allow Virginia Charities to play poker. Pop’s Poker has been at the head of this since the first bill was introduced over 5 years ago. Over the last 2 years since the passing of the bill allowing charities to raise funds by playing poker, it has been an increasing struggle against all odds.


The Virginia Department of Agriculture and Consumer Services (VDACS) which is the home of the Office of Charitable Gaming, has continually dragged their feet and obstructed the promulgation of the law enacting poker in Virginia. They delayed the submission of the regulations surrounding poker, thereby missing a deadline and effectively negating all of the regulations. As a result they have not issued any licenses.


A bill passed in January of 2022 made it illegal to play poker without a license under penalty of a $25,000-$50,000 per occurrence. In essence they shut down the entire industry with one simple bill.


A Virginia Beach charity sought an injunction against this new bill. On June 30, 2022, the injunction was denied and on July 1, 2022, the new law went into effect and all charitable poker in Virginia was shut down under threat of an unusually large and unfair penalty. We sought an appeal with the Virginia Supreme Court, but that was recently denied.


Pop’s Poker is continuing to work every angle and opportunity that we can to open poker back up as soon as possible. We are working both the legal and the political sides of the issue. We have joined forces with other charities in Virginia to band together in this struggle. This is allowing us to hire additional lobbying firms for getting new bills passed in January, and also for additional legal support as has become necessary in order to secure our rights to play the game we love.


We at Pop’s Poker will continue to fight the good fight and keep you updated as soon as we have information to share. We intend to continue to offer freeroll tournaments to keep everyone engaged during this struggle.


We have a wonderful community of dedicated poker players and poker workers in Richmond and we are thankful for each an every one of you!

Virginia erred by criminalizing charitable gaming

Billy the Kidden Rescue Inc. is a charity located in Virginia Beach which specializes in caring for homeless cats. For years the charity existed on a shoestring budget, supported by intermittent donations by animal lovers. In fall 2020, a life raft appeared. Earlier that year, the General Assembly had approved a new game, Texas Hold ‘em, as part of its portfolio of charitable games.


Armed with this opportunity, Billy the Kidden partnered with a local “poker room” which opened up a game and split the profits with the charity, per state law. Two years later and funded by the proceeds of the legal game, Billy the Kidden was the largest cat rescue operation on the East Coast, servicing 550 felines at any one time and receiving referrals from veterinarians all over Hampton Roads. The dream of its president, Emilie Jackson, had become a reality.


Now Billy the Kidden is on the verge of closing. Why? Because the General Assembly, notwithstanding its own laws legalizing Texas Hold ‘em poker, voted in 2022 to effectively put charities out of business for playing this legal game. A last-second lawsuit to enjoin the new law prior to July 1 was unsuccessful. Barring a reprieve from the Virginia Supreme Court, Billy the Kidden — like all Virginia charities that rely on gaming proceeds — will be marked for extinction.


How the heck did this happen?


The seeds of charitable gaming’s demise were ironically planted in the same session as its triumph. In 2020, my legislation (Senate Bill 936) legalized Texas Hold ‘em poker for qualified charities. The purpose of the bill was to expand the menu of charitable gaming options beyond bingo, which had been losing its audience for years, and thereby revitalize Virginia charities. The legislation was warmly received by the American Legion, volunteer fire departments, Elks Lodges and other fraternal organizations that depend on gaming to support their mission.


At the same time, the assembly passed legislation in 2020 that authorized five casinos in Virginia, all in the southern half of the state where charitable gaming has its strongest foothold. A conflict of some type was foreseeable, because why would someone travel to a casino to play a card game which was available at the nearby Veterans of Foreign Wars hall?

What was not foreseeable was how the agency meant to regulate charitable gaming would work so ardently to strangle it, first suspending the enabling regulations for poker and then deferring them indefinitely. Or how the assembly would accept the canard that there was a “problem” in charitable gaming that required a “state commission” culminating in an inspector general report in October which was a Seinfeldian statement of nothingness: no criminal allegations, no ill-gotten profits, no examples of fraud or mismanagement.

Armed with the report, the commission and agency bamboozled the assembly into voting on a series of punitive measures which effectively “re-criminalized” Texas Hold ‘em poker for charities by stating that the game could not be played with “chips denoting a cash value” or in a tournament “with no predetermined end time” — both staples of poker itself. Any charity violating these laws would be subject to a $25,000 minimum fine.


Yes, that fine applies to charities like Billy the Kidden, which has no “profits” because all proceeds are going to save homeless animals. Sadly, the Youngkin administration signed these bills into law without any amendment.


Meanwhile, as the Virginia charities have seen their hard-won freedoms taken away, the professional casinos — all owned by out-of-state companies —- have moved forward with minimal scrutiny as they prepare to open four gaming palaces in 2023. Any comment regarding their practices will simply bring the rejoinder that the games are “played by consenting adults” — a key detail somehow lost in the alleged controversy over charitable gaming.


As the Virginia   Beach judge stated in denying Billy the Kidden’s emergency injunction, the General Assembly has a history of passing “strange and contradictory laws,” such as a poker regulation that bans the wagering of chips with a cash value. These laws are an affront to common sense and the ability of Virginians to make their own decisions. They also discriminate against Virginia charities and openly favor out-of-state professional casinos.

Unless the courts act, the assembly must correct this wrong and repeal these archaic restrictions which punish charities and operators for letting their customers play legal card games.


Virginia Sen. Chap Petersen, a Democrat, represents the 34th District, which includes part of Fairfax County.
